1. Acceptance of Terms

By accessing or using Defyx VPN service, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the service.

2. Service Description

Defyx is a VPN service operated by UnboundTech UG (haftungsbeschränkt). We provide both free and Priority access tiers with varying features and performance levels.

3. Account Registration

Accounts are created through our Telegram bot. You are responsible for maintaining the confidentiality of your account credentials.

4. Acceptable Use

You agree NOT to use Defyx for:

• Illegal activities under German or applicable law
• Distributing malware or conducting cyberattacks
• Spamming or sending unsolicited communications
• Violating intellectual property rights
• Excessive bandwidth usage that degrades service for other users

5. Free vs Priority Access

Free access: Available on a best-effort basis through shared connection capacity. Performance and availability may vary.

Priority access: Provides access to additional capacity for the data allowance, validity period and device limit shown before activation or purchase. Priority access does not guarantee uninterrupted connectivity, a specific speed or access through every restricted network.

Priority access may be obtained through a welcome reward, referral reward, the Free Priority queue or a one-time purchase.

6. Payments and Refunds

Priority access purchases are one-time payments, not subscriptions. The applicable data allowance, validity period and device limit are shown before payment. Validity starts at activation or at the time displayed during the purchase flow.

Access may end when the allowance, validity period, or device limit is reached. Contributions, rewards, or promotional grants are not purchases and can have different conditions.

Refund handling depends on applicable law, payment channel rules, and case-specific circumstances. Nothing in these terms limits statutory consumer rights.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may suspend or terminate service for maintenance, security reasons, or violations of these terms.

8. Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behavior. Users may delete their accounts at any time via the Telegram bot or support contact.

9. Limitation of Liability

Defyx is provided "as is" without warranties. We are not liable for any damages arising from use of the service, to the extent permitted by German law.

10. Governing Law

These terms are governed by German law. Mandatory consumer protection rights under applicable law remain unaffected.

11. Changes to Terms

We may update these terms when required for legal, security, or service reasons. Material changes will be communicated before they take effect.
